If you’re planning to get your departed loved one cremated, there are certain rules and regulations that you, the funeral home, and the crematory should follow. Each state in the US also has its own unique laws that affect what happens to the body of a deceased individual. Here are answers to some of the common questions involving the licensing and operational requirements of cremation:

 

  • Who’s Responsible for Authorizing a Cremation?
    A crematory can’t proceed with the incineration process without a Cremation Authorization Form. The declaration for the disposition of cremated remains should also be signed by the authorizing agent or the next-of-kin of the deceased.

    The authorizing agent can be the spouse, adult children, parents, siblings, and adult grandchildren of the departed. Adult aunts or uncles, nephews or nieces, maternal or paternal grandparents, first cousins, or any other adult relative of the deceased in descending order of blood relationship can also authorize a cremation.

  • Do You Need a Cremation or Disposition Permit?
    The simplest answer to this question is yes. Once you’ve filed the Cremation Authorization Form, the county in which the cremation will take place will issue a disposition or cremation permit. You may have to pay a fee (usually between $10-$40) for the permit, but some counties issue it for free.


  • Are Crematories Required To Have a License?
    Yes, a
    funeral home, crematory, or any company that provides funeral services and merchandise to the public is required to have a license. The manager of such establishments should be a licensed funeral director as well.


  • What Can You Do With the Cremated Remains?
    Each state in the US has its own rules and regulations on what you can do with the cremains of your loved one. But generally, you can keep the cremated remains at home, scatter them in a designated place, store them in a niche or columbarium, or bury them. You can also have them added to the existing grave of a family member.
